Item Involving the Disclosure of Exempt Information

The Sub-Committee is invited to pass the following resolution:-

 

That under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of information as defined in Schedule 12A of the said Act.

Consideration of a Complaint Made Against a Parish Councillor in respect of a Breach of the Code of Conduct for Members

To consider whether or not to refer a complaint for investigation.

Minutes:

The Assessment Sub-Committee determined that the complaint, if proven, would represent a breach of the Code of Conduct and should be referred to the Monitoring Officer for investigation. 

 

The Assessment Sub-Committee were advised that a new standards regime under the Localism Act 2011 would come into force on 1st July 2012.  The transitional arrangements put in place by the Government do not make any provision for an investigation of a complaint made under the Code of Conduct to continue when the new arrangements came into force.  It was established that there would be insufficient time for an investigation into the complaint to be undertaken and completed by 30th June 2012.

 

The Assessment Sub-Committee considered the position to be unsatisfactory but concluded that, because there was no provision under the transitional arrangements for an investigation to continue after 30th June 2012, it would not be possible for the Monitoring Officer to take any further action with regard to the complaint.
