Application for the Grant of a Premises Licence To consider and determine an application for grant of a premises licence in respect of Worcester Kebab House, 5 Shaw Street, Worcester, Worcestershire, WR1 3QQ. Additional documents:
Minutes: The Sub-Committee considered an application for a Premises Licence in respect of Worcester Kebab House, 5 Shaw Street, Worcester WR1 3QQ.
At the start of the meeting, the Chair made the following statement:
“Presentations to the Sub-Committee are not given under oath. However, I would like to remind all parties that the highest standards are expected and any deviation from these high standards could possibly influence any decision of the Sub-Committee.”
All parties at the hearing were introduced. The applicant confirmed he was aware of his right to have legal representation at the meeting but had chosen not to. The applicant confirmed he was satisfied with the proposed procedure.
The Senior Practitioner – Licensing presented the report on behalf of Worcestershire Regulatory Services. The Senior Practitioner – Licensing explained that WRS received an application for a premises licence for the following licensable activities on 25 May 2022:
Office records confirm that the premises previously benefited from a premises licence issued by the Council, authorising “Late Night Refreshment”. This licence lapsed when the limited company which held the licence, “Superdeal Trading Ltd”, was dissolved on 5th December 2017, a fact the Licensing Authority only became aware of on 24th May 2022.
The Senior Practitioner – Licensing confirmed that it was the Licence holder’s responsibility to ensure a current licence was in place.
In summary, the Senior Practitioner – Licensing explained that in considering the application, the Sub-Committee should have regard to the Council’s Statement of Licensing Policy under the Licensing Act 2003. The Sub-Committee is obliged to determine the application with a view to the promotion of the licensing objectives which are:
• the prevention of crime and disorder; • public safety; • the prevention of public nuisance; • the protection of children from harm.
The Senior Practitioner – Licensing confirmed that no representations had been received from responsible authorities in relation to the new application. A representation had however been received from the residents in Shaw Street.
All parties were offered the opportunity to ask questions of the Senior Practitioner – Licensing.
Members of the Committee noted that the premises fell within the City Council’s Cumulative Impact Zone, however the Senior Practitioner – Licensing confirmed it had already been taken into account in the numbers of licensed premises already in the area.
The applicant asked the Senior Practitioner – Licensing asked whether any complaints had been received about the Premises in the 20 years it had been managed by the current owners. The Senior Practitioner – Licensing confirmed that Worcestershire Regulatory Services (WRS) was not aware of any complaints during that time.
